The Texas Legislature in 2013 passed the Use of Unmanned Aircraft statute, which lists legal and illegal uses of drones. One of the legal uses addressed in the statute is “if the image is captured by a Texas licensed real estate broker in connection with the marketing, sale, or financing of real property, provided that no individual is identifiable in the image.”

A lawsuit filed in federal court in Austin challenges the constitutionality of this Texas drone law. The plaintiffs claim that the law violates the First and Fourteenth Amendments.
